These Terms of Use and Purchasing Terms and Conditions (the “Terms”) govern your use of the OnOff Tiles website and your purchase of our products. By using this site or placing an order, you agree to these Terms. You can safely and securely order your OnOff Tiles through our website. OnOff Tiles LLC ensures that all our tiles are crafted with the highest quality and sent directly to you without intermediaries.
Order Confirmation
Once we receive your order, a confirmation email will be sent with the details of your purchase. Please take a moment to review this confirmation to ensure all the information is correct. If anything seems off or if you have any concerns, reach out to our customer service immediately. Keep this confirmation, as it includes your order number in case you need to contact us. If you wish to modify or cancel your order, please contact customer service as soon as possible.
Shipping Method and Delivery Times
- Most orders ship within 48 hours and arrive 2 to 3 business days after they ship. FedEx transit times range up to 5 business days, depending on your location. Full detail is on our Shipping & Delivery page.
- All products are shipped directly to your home or business.
- Please note that delivery times may be affected by shipping carriers’ delays.
- We currently ship within the United States only, so no import taxes, duties or customs fees arise. If we begin shipping to other countries these terms will be updated before any order can be placed from one.
Payment Options
We accept debit and credit cards (Visa, Mastercard, American Express and Discover), Apple Pay and Google Pay. Payments are processed by Stripe.
Returns & Complaints
All products come with a one-year guarantee. The guarantee covers only defects present at the time of delivery. If your product arrives damaged or faulty, we will replace it free of charge.
Separately from that guarantee, we accept change-of-mind returns and swaps of uninstalled tiles within 30 days of delivery. The full terms (including who pays return shipping, the condition tiles must come back in, and how custom uploads are treated) are set out on our Returns & Refunds page, which forms part of these Terms.
We are not liable for any additional costs that arise due to a faulty or defective product, such as extra materials or labor. It is the customer’s responsibility to inspect the product before installation. We do not offer reimbursement for faulty installations. In the case of any dispute, Virginia law will govern, and we will follow the recommendations of relevant consumer protection agencies. Upload Your Own: Image Content Terms
1. User Upload of Image Content
When you place an order for a tile or set of tiles through OnOff Tiles using the “Upload Your Own” option, you agree to the following representations, warranties and acknowledgements:
1.1 Ownership & Usage Rights
You represent and warrant that:
- You are the owner of the image(s) you upload, or you have obtained all necessary rights, licenses, permissions and clearances (including intellectual property rights, copyright, trademark, rights of publicity/privacy, moral rights, etc.) to permit OnOff Tiles (and its service providers) to reproduce, print, display, fulfill and deliver the image(s) on the tiles.
- The image(s) are not infringing the rights of any third-party, including copyrighted material (for example images of celebrities, copyrighted artwork, branded content, licensed stock, etc.).
- The image(s) are free of any obligation, lien, claim or third-party restriction that would prevent OnOff Tiles from printing them and delivering them to you.
You grant OnOff Tiles a non-exclusive, worldwide, royalty-free license to print and reproduce the image(s) on the tile(s) you order (and to use them only for that purpose of fulfilling your order and any after-sale service).
1.2 Consent & Release
If the image(s) depict a person other than you, you represent and warrant that you have obtained all necessary consent(s) of the depicted person(s) for the reproduction of their likeness for printing and display.
1.3 Prohibited Content
You agree not to upload any image(s) that:
- You know or suspect are copyrighted by someone else (and you have not obtained permission).
- Depict a celebrity, trademarked or branded content, or other third-party rights unless you have permission/license.
- Violate any law, regulation or third-party rights (including privacy, publicity, moral rights).
- Are otherwise offensive, defamatory, pornographic, or unlawful.
1.4 Quality & Printability
You acknowledge that OnOff Tiles may specify image resolution, file type, color or format requirements; you are responsible for ensuring your image meets the required standard. OnOff Tiles may reject or request a substitution of an image that does not meet required specifications or is otherwise unsuitable for printing.
2. OnOff Tiles’ Rights & Discretion
2.1 OnOff Tiles reserves the right (but not the obligation) to:
- Review, refuse, cancel or delay printing of any order that uses “Upload Your Own” if OnOff Tiles, in its reasonable discretion, determines (or suspects) the image(s) may infringe third-party rights or are otherwise unsuitable.
- Remove or refuse to print any image(s) that appear to violate copyright, trademark, public-persona or other third-party rights.
- Cancel the order and notify you if such concerns arise, without liability beyond refunding your payment (less any shipping/delivery cost, if applicable).
2.2 OnOff Tiles does not guarantee that by accepting your upload, no third-party claim will be made. You agree to indemnify, defend and hold harmless OnOff Tiles (and its affiliates, agents, subcontractors) from any and all claims, damages, costs (including legal fees) arising from your breach of the representations above (for example, printing an image you do not have rights to).
3. Your Acknowledgement
You acknowledge that:
- Printing an image does not automatically mean it is lawful. Even if you agree to these terms, you remain responsible for ensuring the image(s) are permissible for printing.
- OnOff Tiles’ acceptance of upload and printing does not relieve you of your liability to third-parties for copyright, trademark or other rights infringement.
- OnOff Tiles may (but is not obliged to) screen or audit the content you upload; however, the fact that OnOff Tiles printed your order does not mean OnOff Tiles certifies or guarantees that the image is lawful or free of infringement.
4. Refusal or Cancellation
If OnOff Tiles cancels your order under section 2.1 for any reason relating to image rights or suitability:
- OnOff Tiles will notify you via email (or through your account) of the cancellation.
- You will receive a refund of your payment for the cancelled order (subject to shipping, processing deduction if applicable).
- OnOff Tiles shall not be liable for any indirect or consequential damages arising from the cancellation (for example lost time, missed decor deadline, etc.).
5. Amendments & Survivability
These provisions relating to user-uploads and intellectual property rights survive any termination of your account or winding-down of services. OnOff Tiles reserves the right to amend or revise these terms at any time (with appropriate notice to you) and your continued use of the “Upload Your Own” service constitutes your acceptance of the updated terms.
Intellectual Property
All content on this website that is not user-uploaded (including the OnOff Tiles and “Stick. Style. Swap.”™ names and logos, site design, text, graphics, and the original artwork and designs offered for sale) is owned by OnOff Tiles LLC or its licensing artists and is protected by copyright, trademark and other laws. Artwork sold through OnOff Tiles is licensed to you for personal, non-commercial display only; purchase of a tile does not transfer any copyright or right to reproduce, resell, or create derivative works from the artwork.
Copyright Complaints (DMCA)
We respect the intellectual property of others. If you believe that content on our site (including a user-uploaded image) infringes your copyright, please send a notice to our designated agent at our contact form including: (a) your contact information; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it appears; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act on the owner’s behalf. We will respond to valid notices, including by removing or refusing to print the material where appropriate.
Acceptable Use
You agree not to use the site or our products to violate any law or third-party right, to upload malicious code, to interfere with the site’s operation, or to attempt to gain unauthorized access to any account or system. We may suspend or terminate access for any violation of these Terms.
Disclaimer of Warranties
Except for the express one-year defect guarantee stated above, the website and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free, or that colors displayed on your screen will exactly match the printed product.
Limitation of Liability
To the fullest extent permitted by law, OnOff Tiles LLC and its owners, employees, affiliates, agents and subcontractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or missed deadlines, arising out of or related to your use of the site or products. Our total aggregate liability for any claim arising out of or relating to these Terms or a purchase will not exceed the amount you paid for the product(s) giving rise to the claim.
Indemnification
You agree to indemnify, defend and hold harmless OnOff Tiles LLC and its owners, employees, affiliates, agents and subcontractors from any claims, damages, liabilities, and costs (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the site or products, or (in the case of the “Upload Your Own” service) your upload of any image you do not have the rights to use.
Use of Personal Data
By placing an order, you consent to OnOff Tiles LLC storing and using your personal and purchase information to fulfill your order and enhance your customer experience, as described in our Privacy Policy. Creating an account or placing an order also adds you to our email list, and we will write to you about new art and swap ideas. You can unsubscribe in one click, from any of them, and it takes effect immediately; order confirmations, shipping updates and other messages about a purchase are not marketing and continue either way. We handle your personal data with care and will not share it with third parties except as needed to complete your order (e.g., payment processing or shipping) or as required by law.
Payment Security
We offer secure payments through our trusted payment provider, Stripe. OnOff Tiles LLC does not handle or store any card information. For more information about payment security, please visit Stripe’s website.
